Privacy Policy of the online store (B2B shopping platform) b2b.aqua-art.pl (hereinafter referred to as Aqua Art)
$1 PERSONAL DATA CONTROLLER
- The controller of personal data of Customers and other users of the Online Store (who do not place Orders) collected via the Online Store in order to enable the use of services provided electronically as part of the b2b.aqua-art.pl website (e.g. the service of setting up and maintaining a user account in the Store, newsletter service, contact forms, etc.) is Aqua Art Bartłomiej Lipczyński (hereinafter referred to as Aqua Art) entered into the Central Register and Information on Business Activity maintained by the minister responsible for economy and maintaining the Central Register and Information on Business Activity, NIP 8671193757, REGON no. 831357954, ul. Przyrzecze 18, 05-510 Konstancin-Jeziorna (hereinafter referred to as Aqua Art).
$2 PERSONAL DATA AND PRIVACY

Personal data is all information about an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or by one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. Personal data may include a device's IP address, location data, online identifier, and information collected through cookies and other similar technologies.
If you intend to create a User Account and use the Online Store's services, you will be asked to provide us with your personal data.
Your data is processed by Aqua Art separately for the purposes indicated below, related to the operation of the Store and the provision of the services offered therein:
- Providing services offered in the Store electronically,
- Implementing the purchasing process and processing your orders, including identifying the sender and handling their inquiry sent via the form provided,
- Resolving complaints, including fulfilling obligations arising from the warranty for defects in order to handle, recognize, resolve, and respond to complaints, as well as to issue and store relevant documents required by tax regulations in connection with complaints and warranties,
- Direct marketing of the services offered, other than a newsletter,
- Sending a newsletter,
- Conducting marketing (remarketing) activities, including contextual advertising, i.e., displaying marketing content not tailored to the Customer's preferences,
- Promoting brands produced by Aqua Art on social media,
- Analyzing the Store's Customer activity, how they use their account, and their preferences, in order for Aqua Art to improve the solutions used in the Online Store.
4. Personal data provided to Aqua Art are processed on the following basis:

- Performance of a contract for the provision of services by electronic means or actions taken at your request before concluding that contract (Article 6 paragraph 1 letter b of the GDPR),
- Our legal obligation, e.g. related to accounting (Article 6, paragraph 1, letter c of the GDPR),
- Your consent expressed in the Store - if you decide to express it, e.g. in the scope of receiving marketing information (Article 6, paragraph 1, letter a of the GDPR)
- Our legitimate interest in processing data for the purpose of:
- establishing, pursuing, or defending potential claims (Article 6, paragraph 1, letter f of the GDPR),
- conducting direct marketing, marketing (remarketing) activities, including contextual advertising,
- processing data for analytical and statistical purposes, including profiling,
- conducting customer satisfaction surveys,
- ensuring the ability to contact you using electronic contact forms. Using the form requires providing personal data necessary to contact the user and respond to your inquiry,
- sending you a newsletter or other form of direct marketing, which may contain commercial information,
- informing users about Aqua Art's activities and promoting various events, services, and products through the Store's social media profiles (e.g., Facebook, YouTube, Instagram).
5. Providing data is voluntary, but in some cases it may be necessary to conclude and implement the contract. The effect of not providing data, depending on the purpose for which the data is provided:

- no possibility to register in the Store;
- inability to use the Store's services;
- no possibility of making purchases in the Store;
- inability to receive information about promotions or special offers offered in the Store;
- inability to receive suggestions for products you may be interested in.
6. Where data processing is based on your consent, you may withdraw your consent to the processing of your personal data at any time by sending an email to handel@aqua-art.pl. Simply provide the email address you registered your account with and state your intention to withdraw your consent to the processing of your personal data.
7. Providing personal data to subscribe to the newsletter service is not mandatory; however, failure to do so may result in the service being impossible to provide. Similarly, withdrawing consent to the processing of personal data or objecting to the processing of personal data may affect the ability to provide the newsletter service.
8. Aqua Art does not process special categories of personal data or personal data relating to criminal convictions, offences, or related security measures. Special categories of data include: personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data relating to a uniquely identified natural person, or data concerning that person's health, sex life, or sexual orientation.
$3 PROFILING
- As part of the Store's operation, Aqua Art may automatically tailor certain content to your needs, i.e., perform profiling using your personal data. This profiling primarily involves automatically assessing which products you may be interested in based on your previous activities, displaying targeted product advertisements, and sending newsletters, provided you have consented to receive them.
- The profiling we perform does not result in decisions being made that have legal effects on you or affect you in a similarly significant way.
$4 PROCESSING PERIOD
- We will process your personal data only for the period in which we have a legal basis to do so, i.e. until:
- We cease to be legally obligated to process your data,
- Your ability to pursue claims related to the contract concluded between the Parties ceases,
- You withdraw your consent to data processing if it was the basis for it,
- Your objection to the processing of your personal data is accepted – if the basis for processing your data was the legitimate interest of the controller or if the data was processed for direct marketing purposes, including profiling – depending on what is applicable in the given case and whichever occurs latest.
2. If the processing of personal data is based on consent, your withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
$5 DATA SECURITY
- Aqua Art makes every effort to ensure all physical, technical and organizational measures to protect personal data against accidental or intentional destruction, loss, alteration, unauthorized disclosure, use or access, in accordance with all applicable regulations.
- When processing your personal data, Aqua Art uses organizational and technical measures in accordance with applicable law.
$6 YOUR RIGHTS
- In connection with the processing of your personal data, you have the right to request:
- access to your personal data
- rectification of your personal data
- deletion of your personal data
- restrictions on the processing of your personal data
- requests to transfer data to another controller
- object at any time to the processing of your data, subject to paragraph 2.
- You have the right to object at any time to the processing of your personal data when the processing is based on a legitimate interest or for statistical purposes, and the objection is justified by your particular situation, or when your personal data is processed for direct marketing purposes, including profiling, to the extent that the processing is related to such direct marketing. In such a case, Aqua Art will cease processing your personal data for these purposes unless it can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or your data is necessary for the establishment, exercise, or defense of Aqua Art's claims.

- Aqua Art reserves the right to send users commercial information regarding its activities and those of its partners and contractors. This right arises if you consent to receiving a newsletter or otherwise receiving commercial information.
